Know The Facts About Criminal Records
In the United States, criminal records are considered background records and list any incident in which you have been convicted of a crime. The criminal record along with any arrest records will be on file depending on which records are allowed to be released to the public and vary by state. You can get a criminal record for something as simple as a traffic violation to more serious crimes such as misdemeanors and felonies. No crime is too small to document as a criminal matter if you have been determined guilty by the court system.

Criminal records can include basic identifying information such as your full name, age, date of birth along with any felonies or misdemeanors that you were convicted of. You may also find previous and current addresses, court records and warrants, court docket information and other data related to your case. A background check will list a comprehensive criminal history of all past offenses, with the exception of any records that have been expunged.

In the United States, criminal records are compiled and held at the local, state, and federal levels by various law enforcement agencies. Local police departments, sheriffs' offices, and other law agencies maintain their own internal databases as a way of upholding the law and often share this information with other enforcement agencies in order to get assistance in fighting crime.

All states in the U.S. have what is known as a "statewide repository" that holds and maintains public records. Those records include criminal history information. Criminal records are contributed by the various county and municipal courts and law enforcement agencies for each state. Any person may freely request their own background records to see what their public records show. Depending on the state and process there may be a fee to obtain a personal background report.

If you're not sure about how your background check will turn out its important to know. Past incidents such as driving violations, speeding tickets, DUI’s, arrests, or criminal history can have a significant impact on your life. You can conduct an online search from the search box above on this site. Start by typing in the first and last name of the person you'd like to source and you're on your way to finding out in seconds. Since court records are serviced by both local and federal courts in the United States, this information is available to you to research the background of an individual or business. The system will allow you to verify your own public information, or any person's background including arrest records, criminal records, court records and civil filings nationwide. You can also use the search system to research your ancestors or family history as the system will search public records including death records, divorce records, and marriage records.

After conducting an online search, if you find information on your background report that you would like to get expunged or removed from your personal record, there is a process in place with the courts that will allow you take action. Please see our page on expungement for more information.

Court Records and Your Privacy
Access to U.S. public records is organized and governed by the Freedom of Information Act (FOIA), which allows for the full or partial disclosure of public records documented by the United States government. FOIA gives any person the right to request access to federal agency records or information unless the records are protected from disclosure or have been expunged

There is no statue of limitations on criminal records which means that criminal records stay on your file for life unless the record has been sealed, expunged or pardoned by a judge. If you're looking for a new job you should know that most employers these days do a background check before they consider hiring for almost any position. Even if you are applying for a part time job, more and more businesses are making an extra effort to check a person's background before hiring. All past arrests and outstanding warrants will show up on a background check and could cost you the job.

Arrest Record vs Criminal Record
Many people get confused between what an arrest record, criminal record and police record is. Although they all have to do with the law, the records hold different consequences on your public file.

Arrest records and police records are basically the same thing and the terms can be used interchangeably. They both refer to the arrest itself and any data related to the crime you were arrested for. Any time you are taken into custody by law enforcement for any reason, an arrest record will be created for the incident. It will state what the crime you were arrested for, date and time of arrest, the name(s) of arresting officer(s), your name, DOB, address, any other information related to the crime and usually includes a mug shot and fingerprints which will be processed at the time you are taken into custody. An arrest record means you got arrested as a suspect in a crime. It does not mean you are guilty of the crime. That will be determined through the court system by a judge and jury.

Once you are arrested you will have a chance to hire a lawyer and prove your case in court. Depending on evidence and witness testimony, a jury will decide your guilt or innocence. If you are arrested and found guilty of the crime, then you will now have a criminal record as well as an arrest record. Both of these records will show up on  background check. It's important to know what your background report shows  since it can effect employment, getting an apartment or other factors of your life.,

If you are arrested and facing a trial you will surely want to hire a lawyer to assist you. A criminal lawyer will help gather witnesses, represent you in court, post bail, and guide you through your case for the best outcome. If you can't afford a lawyer one will be appointed for you by the court system. The U.S. Judicial system is based on the fact that everyone is innocent until proven guilty and must have their right to a fair trial.
